Please read these Terms and Conditions (“Terms”) carefully before using the Riverlog web and mobile application (“the Service”) operated by Jan Procházka and Eliška Kadubcová (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility and User Accounts

To use the Service, you must register an individual account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.

You may not register a username that:

• impersonates someone else,
• includes a trademark or brand name you do not own,
• or contains vulgar or offensive language.

2. Description of the Service

The Service is accessible via web browsers and native mobile apps for Android and iOS. It allows users to:

• Create records/logs with information about river trips;
• Access up-to-date information about rivers, such as current water levels;
• View records shared publicly by other users.

3. User-Generated Content

You are fully responsible for any content you submit to the Service. You must ensure your contributions are lawful and appropriate. We reserve the right to remove or restrict content that we determine, at our sole discretion, to be inappropriate, offensive, or in violation of these Terms.

4. Third-Party Services and Data

The application may display content or data from third-party providers (e.g., river condition data). We do not guarantee the accuracy, completeness, or reliability of this information. Use of such data is at your own risk.

We are not responsible for the content, policies, or practices of any third-party services, even if accessed through our Service.

5. Service Availability

We make no guarantees that the Service will be available at all times or function without interruptions. Access may be temporarily suspended or limited due to maintenance, technical issues, or other reasons. We disclaim liability for any inconvenience or loss caused by such unavailability.

6. Disclaimer of Liability

All content and data in the Service are provided for informational purposes only. You use the Service at your own risk.

Under no circumstances shall the application or its owners, team members, partners, agents, service providers, or affiliates be held responsible for any indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, losses such as reduced profits, data loss, inability to use the Service, loss of reputation, or any other non-material harm arising from:

1. your use of, or inability to use, the Service;
2. actions, omissions, or content posted by third parties within the Service;
3. any information or materials accessed through the Service;
4. unauthorized access to or changes made to your data or communications.

7. No Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, whether express or implied. We do not warrant that the Service will meet your requirements, be secure, uninterrupted, timely, or error-free.

8. Subscription and Pricing

Currently, the Service is offered free of charge. Should we introduce a paid subscription model in the future, users will be notified in a reasonable timeframe in advance. Users will retain either continued access to their personal records created before the introduction of paid features, or the ability to export those records free of charge.

9. Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, if you breach these Terms or misuse the Service.

10. Changes to Terms

We may modify these Terms at any time. If we do, we will provide notice by updating the date at the top of this document or through the Service. Continued use of the Service after such changes means you accept the new Terms.
